Your health is your responsibility. The management and staff of this organisation are dedicated to helping you take every opportunity to enjoy the facilities that we offer. With this in mind, we have carefully considered what we can reasonably expect of each other.
Our commitment to you: -
1. We will respect your personal decisions and allow you to make your own decisions about what exercise you can carry out. However, we ask you not to exercise beyond what you consider to be your own abilities.
2. We will make every reasonable effort to make sure that our equipment and facilities are in a safe condition for you to use and enjoy.
3. We will take all reasonable steps to make sure that our staff are qualified to the fitness industry standards as set out by the Register of Exercise Professionals.
4. If you tell us that you have a disability which puts you at a substantial disadvantage in accessing our equipment and facilities, we will consider what adjustments, if any, are reasonable for us to make.
5. Your health is your responsibility. The management and staff of this organisation are dedicated to helping you take every opportunity to enjoy the facilities that we offer. With this in mind, we have carefully considered what we can reasonably expect of each other.

1. You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition which might interfere with you exercising safely, before you use our equipment and facilities you should get advice from a relevant medical professional and follow that advice.
2. You should make yourself aware of any rules and instructions, including warning notices, and follow them. Exercise carries its own risks. You should not carry out any activities which you have been told are not suitable for you.
3. If you have a disability, you must follow any reasonable instructions to allow you to exercise safely. This statement is for guidance only. It is not a legally binding agreement between you and us and does not create any obligations which you or we must meet.
4. You agree to take responsibility for your own wellbeing during unmanned hours.

3F Gym Ltd has set these Membership Rules

To make sure that using our gyms is as safe and enjoyable an experience as we can make it for all of our Members.
We may change the rules set out to reflect new business requirements.
3F GYM Ltd reserve the right to terminate your Membership immediately if you do not abide by these Membership Rules. We hope that you understand.
Members of 3F GYM will agree to the following:
Always use sanitizer spray and paper towels provided to clean the equipment when you have finished using it.
Replace equipment back onto the racks after you have finished with it and after you have cleaned it.
Listen to staff members instructions and directions, especially in relation to social distancing measures, and adhering to one-way system rules if they are in place.
Follow the gyms social distancing guidelines to keep apart from other members and staff.
Wash your hands regularly with soap and water for at least 20 seconds whilst at 3F GYM.
Carry and use a towel for personal use only and not to wipe equipment. Please use the cleaning stations for wiping down gym equipment after you have used it.
If you are feeling unwell, have symptoms or have tested positive for coronavirus, please do not attend the gym. You must follow government regulation on isolating for a minimum period of time, and only return after this minimum period if you are feeling well again.
Members must have left the premises before closing time.
You must complete the gym induction, especially if you are a first-time visitor to 3F GYM.
Members must not leave bags on the gym floor.
Members must lower weights down gently on to the floor in the gym.
Members leave property in lockers at their own risk. 3F GYM will not be held responsible for any loss or damage.
Suitable clothing is to be worn whilst training at all times. This includes proper footwear. This includes tops must be worn at all times and no sliders. Failure to do so you may be asked to leave the premises by the management team.
If you are unsure about the use of equipment please ask a member of staff to assist you.
Never try any physical exercise activity that could be dangerous to you or other members of 3F GYM. Any boxing or contact sports should only be undertaken under the instruction of a qualified instructor.
Never block or interfere with fire, emergency doors or alarms. These should only be used in an emergency.
Never tamper with fire extinguishers.
Any aggressive, abusive, intimidating, anti-social or threatening behaviour towards staff or Members will not be tolerated
If you are not a 3F GYM PT you must not train anybody at our premises. If it is made known to management that you are training someone on our premises, your membership could be revoked as a consequence.
Always arrive and leave the gym with respect of our neighbours.
Never park your bicycle in an unsafe or in an inappropriate location.
Use of the gym whilst under the influence of alcohol, and narcotics is strictly prohibited.
Members should not be involved with any type of criminal behaviour whilst at our gym.
Members shall not cause damage to the premises, or another Member's property.
No food to be consumed on the gym floor. Please use the café provided.

3F Gym Terms & Conditions

Please read the following important terms and conditions before you buy anything from us and check that they contain everything which you want us to do for you and nothing that you are unwilling to agree to.
In this contract:
We, us, our, or ours means 3FGym Ltd, a company registered in England and Wales under company number 12674935. Our registered office is at 14 Warburton Road, Poole, England, BH17 8SF.
You or your means the person being a User.
User: means a Day Pass User or a Member.
Day Pass User: means a person entitled to use the Facilities at any time the Facilities are open over a single day.
Facilities: means the exercise equipment, changing rooms, showers, and training areas at the 3F Gym, Lower Ground Floor, Parkway House, 26 Avenue Road, BH2 5SL Bournemouth.
Membership Month: If you have a Monthly Membership, The day of the month that yours Membership starts or is renewed, until the day preceding it in the next month. As an example, if it commences on 16th June, the Membership Month will end when the gym closes on 15th July.
Membership Year: If you have a Yearly Membership, The day of the year that your Membership starts or is renewed, until the day preceding it in the next year. As an example, if it commences on 16th June in year 1, the Membership Month will end when the gym closes on 15th June in year 2.
Member: A person entitled to use the Facilities at any time the Facilities are open over the term of their membership subject to the terms of this contract..
Membership: your usage of the Facilities as a Member in accordance with this contract.
Membership Particulars: the information supplied on the members area of our website
Monthly Membership: a Membership for a period of one month in accordance with the terms of this contract.
Yearly Membership: a Membership lasting for a period of one year in accordance with the terms of this contract.
Additional Services: Such additional services as may be agreed between us and you from time to time.

1. INTRODUCTION
1.1 If you become a User you agree to be legally bound by this contract.
1.2 When becoming a User you also agree to be legally bound by our Gym Rules, the current versions of which are set out on our website. The 3F Gym Rules form part of this contract as though they are set out in full here. We may change the Gym Rules from time to time for regulatory or legal reasons or to enable the better running of the Facilities or any Additional Services. We will endeavour to give you as much notice as possible if we do this. You may end this contract with effect from the date that any changes come into force if you do not accept them.
2. BECOMING A USER
2.1 Every time that you use the Facilities as a Day Pass User, you will need to make a one-off payment to our staff prior to using the Facilities at the prevailing rate. We may decline to allow you to use the Facilities
2.2 If you wish to become a Member, you must complete a Membership application online using our website, which we will then acknowledge; however this acknowledgement does not mean that your Membership application has been accepted. We may contact you to say that we do not accept your Membership application.
2.3 If we do not allow you to be Day Pass User, or if we do not accept your Membership application, we will try to let you know why. However, this is typically for one of the following reasons:
(a) We cannot provide Membership (this may be because, for example, we have no vacancies);
(b) We cannot authorise your payment;
(c) We have concerns about the suitability of the Facilities for you;
(d) There has been a mistake on the pricing or description of the services;
(e) You have broken the terms of any previous contract with us.
2.4 We will only accept your order when our representative confirms this to you, or we confirm this to you by email. At this point, a legally binding contract will be in place between you and us. If you are under the age of 16 you may become a User with our consent, and if a parent or guardian who is also a User, uses the Facilities at the same time that you do, and supervises you throughout your usage of the Facilities.
3. CIRCUMSTANCES BEYOND OUR CONTROL AND TEMPORARY CESSATION
3.1 Your use of the Facilities or any Additional Services might be affected by events beyond our reasonable control. If so, there might be a delay before you can use some or all of the Facilities. Having made reasonable efforts to limit the effect of any of those events and having kept you informed of the circumstances, we will try to restart the use of the Facilities or Additional Services as soon as those events have been resolved. If you are a Member and the Facilities or Additional Services are closed for an extended period, we may, in our sole discretion, offer a reduction of the Membership fees. Examples of events which might be beyond our reasonable control include:
(a) A need to close as a result of a fire, power cut, or other damage to the Facilities;
(b) Outbreak of any virus or disease, or any related government restrictions or laws.
3.2 From time to time, we may need to close all or part of the Facilities in order to undertake essential maintenance or cleaning, or are otherwise required to do so in the interests of safety or following request by any public authority. Where this is necessary, we will take reasonable steps to minimise the disruption caused by the closure of the Facilities.
4. CHARGES AND PAYMENT
4.1 If you are a Day Pass User, you must pay to use the Facilities in advance. The prices are listed on our website and at the gym are gross.
4.2 If you are a Member,
(a) If you are a Monthly Member, you must pay for your Membership in advance, for each Membership Month by no later than the commencement of each Membership Month, or on such dates as we have otherwise agreed with you in writing. You must pay by Permanent Account number (Also known as long card number).
(b) If you are a Yearly Member, you must pay for your Membership in advance or on such dates as we have otherwise agreed with you in writing. You must pay by Permanent Account number (Also known as long card number).
(c) The prices listed in the Membership Particulars are gross.
(d) If you are a Monthly Member, your Membership will run from the date you become a Member for the Membership Month. Your Membership will be automatically renewed for successive Membership Months unless cancelled or terminated in accordance with clauses 6, 7 or 8.
(e) If you are a Yearly Member, your Membership will run from the date you become a Member for the Membership Year. Your Membership will be automatically renewed for successive Membership Years unless cancelled or terminated in accordance with clauses 6, 7 or 8.
(f) We may periodically need to increase our Membership fees. If you do not wish to accept an increase in the Membership fees, you may cancel your Membership by giving written notice to us under clause 7.2. If the change to Membership fees is to apply before the end of the notice period under clause7.1 or 7.2, your termination can take effect from the date immediately before the price increase. You must continue to pay the Membership charges at the current rate until the termination date. We will refund any subscriptions that have been paid by you for any period after the termination date within three to five working days.
(g) Our Membership fees, and the facilities that we provide, are subject to any promotions that we may offer from time to time, such as a price reduction, the provision of additional activities, or taster sessions. Where we have provided a promotion, we may withdraw or amend it at any time.
(h) Where you are a member and have taken advantage of a promotion offered by us resulting in a lower Membership fee for a Membership Month or all or part of a Membership Year, the payment taken from your account will be reduced while that promotion is in place but will increase automatically to the full amount once the promotion ends.
4.3 If any payment you are required to make under this contract is not paid when due, we may charge interest on any balance outstanding at the rate of 8% per year above the rate set by Bank of England base rate. For the avoidance of doubt, you may not use the Facilities where any payment due from you is overdue without our consent.
4.4 Nothing in this clause affects your legal rights to cancel the contract during the cancellation period as set out in clause 6.

4.5 We hold the right to charge you an additional administration fee of £5 per payment missed attempt. To avoid this please make sure to get in touch with us via email at Bournemouth@3fgym.co.uk

4.6 For any upfront payment made(3,6 & 12 month deals) which is followed by a refund request after the 14 day cooling off period or having used the gym more than 2 times. 3F Gym holds the right to increase what would have been monthly payments to the standard rate and only refund what is then subsequentially left over.
5. ADDITIONAL SERVICES
5.1 We may, from time to time, offer Additional Services which will incur extra costs. If you choose to use an Additional Service, you must pay for it prior to use.
5.2 If you reserve any Additional Services, there may be a minimum cancellation period that will apply which we will inform you of. If you cancel within the minimum cancellation period, you shall be liable to pay for the Additional Services in full. There may be other terms and conditions that apply in respect of the Additional Services, which we will notify you of prior to accepting your booking in respect of them. For the avoidance of doubt, the limitations of liability set out in clause 11 apply in respect of any Additional Services provided.
5.3 From time to time, we may permit third party businesses, such as personal trainers, to provide services at the gym for Users. If you wish to accept services from these third parties, you will enter into a contract with them direct. They, and not we, will be responsible for providing you with those services. Unless those third parties and We agree otherwise, you will need to arrange to make a payment direct to them.
6. RIGHT TO CANCEL
6.1 If you are a Member and have entered into this contract using our website, you have the right to cancel this contract within 14 days without giving any reason and we will reimburse you for all sums paid. However, if your Membership started within the 14 days following entry into this contract, you must pay us a proportionate part of the fees in respect of the time when you were a Member.
6.2 The cancellation period will expire after 14 days from the day on which this contract started.
6.3 To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, email, or if you prefer using any form of cancellation notice supplied by us to you) using the contact details on our website.
6.4 To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
6.5 This does not affect the rights you have if we do not comply with the terms of this contract. See also clauses12 and 13below.
6.6 We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement. Refunds will be made no later than 14 days after the day on which we were informed about your decision to cancel.

6.7 If you sign up on a promotional period your first initial contract will be 2 months and will then proceed to be 1 month rolling with the usual 30 day notice of cancellation.
7. HOW YOU OR WE MAY END THIS CONTRACT
7.1 If you are a Day User, this contract will end when you have ceased using the Facilities, which shall, for the avoidance of doubt, be no later than the closing time on the day of use.
7.2 If You are a Monthly Member, unless You and We have agreed otherwise, either You or We may bring this contract to an end on the last day of any Membership Month by giving not less than 30 days notice in writing by post or email. As an example, if your Membership Month runs from 16th June to 15th July, and you wish to terminate, then you would need to give us notice of your intention to end this contract by no later than 15th June in order for it to end on 15th July. When informing us of your cancellation the membership payment request for the following month will be charged effective immediately.
7.3 If You are a Yearly Member, unless You and We have agreed otherwise, either You or We may bring this contract to an end on the last day of the Membership Year by giving not less than 30 days notice writing by post or email before the end of the Membership Year. As an example, if your Membership Year runs from 16th June in year 1 to 15th June in year 2, and you wish to terminate, then you would need to give us notice of your intention to end this contract by no later than 16th May in order for it to end on 15th June.

8. OTHER SITUATIONS IN WHICH WE MAY END THIS CONTRACT
8.1 We may end our contract with you at any time by writing to you if:
(a) You do not make any payment to us when it is due and, if you are a Member, you still do not make payment within 10 days of us reminding you that payment is due. Please note that you cannot use the Facilities or any Additional Services while you owe us any sums;
(b) You do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the Facilities for you to use;
(c) You seriously, or repeatedly, break any other term of this contract.
8.2 You must compensate us if you break the contract. If we end the contract in the situations set out in Clause 8.1 we will refund any money you have paid in advance for services we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
9. END OF THE CONTRACT
If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
10. USER HEALTH AND INDUCTION
10.1 We are reliant on you to ensure that all of the information that you provide to us is accurate and up to date. You promise that any information you provide to us will be accurate and up to date.
10.2 You promise that you will ensure you are in good health and capable of using the Facilities and any Additional Services that you may use without risk of harm to yourself, or any other person.
10.3 Our staffs are not medically qualified, and if you are in any doubt as to the suitability of the Facilities or Additional Services you may use, you should seek independent medical advice before engaging in any use of the Facilities or Additional Services.
10.4 You must ensure that your use of the Facilities and/or the Additional Services you may use is within your capability and you are not over stretching your capabilities.
10.5 You must attend a gym induction before using the Facilities or any Additional Services or alternatively agree to our health statement via providing your personal information once all read and agreed.
11. LIMIT ON OUR RESPONSIBILITY TO YOU
11.1 Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:
(a) Losses that:
(i) Were not foreseeable to you and us when the contract was formed;
(ii) Were not caused by any breach on our part;
(b) Losses caused by you not taking care of your possessions;
(c) Losses caused by you not using the Facilities safely and in accordance with the directions of our staff;
(d) Business losses;
(e) Losses to non-consumers; and
(f) Losses which are the responsibility of any third party business providing services under clause 5.3
12. DISPUTES
12.1 We will try to resolve any disputes with you quickly and efficiently. If you are unhappy with any other matter, please contact us as soon as possible.
12.2 In addition, if you and us have entered into this contract online, please note that disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform.
12.3 If you want to take court proceedings, the courts of the part of the United Kingdom in which you live will have non-exclusive jurisdiction in relation to this contract. The laws of England and Wales will apply to this contract.
13. IF THERE IS A PROBLEM WITH THE FACILITIES
13.1 Nothing in this contract affects your legal rights under the Consumer Rights Act 2015 (also known as statutory rights). You may also have other rights in law.
14. YOUR PRIVACY AND PERSONAL INFORMATION
14.1 Our Privacy Policy is available at www.3fgym.co.uk.
14.2 Your privacy and personal information is important to us. Any personal information that you provide to us will be dealt with in line with our Privacy Policy, which explains what personal information we collect from you, how and why we collect, store, use and share such information, your rights in relation to your personal information and how to contact us and supervisory authorities if you have a query or complaint about the use of your personal information.
15. TRANSFERRING RIGHTS TO SOMEONE ELSE
15.1 You may not transfer your rights or your obligations under these terms to another person unless we have previously agreed this in writing.
15.2 We may transfer our rights under this contract to a third party by giving notice to you, however we will only do this if it will not adversely affect your rights under this contract.
16. THIRD PARTY RIGHTS
16.1 No one other than a party to this contract has any right to enforce any term of this contract.

17. GIFT VOUCHERS

17.1 Voucher expiry date is 3 months from purchase date.

17.2 Voucher entitles the holder to the gifts stated on the voucher.

17.3 Voucher cannot be exchanged or refunded for cash.

17.4 Voucher is for one-time use only and any unused value will not be refunded.

17.5 Original voucher, or digital gift card number must be submitted at purchase, photocopies or other forms will not be accepted.

17.6 Voucher will not be replaced if lost, damaged or stolen. Any damages of the voucher may not be accepted.

17.7 3F Gym reserves the rights to vary the terms and conditions without prior notice. In case of any disputes, 3F Gym decision will be final.
